US CPSC Ties Counterfeit Safety Marks to Trade Fraud: What Leather Jacket Importers Must Document

Nov 2,2026

On October 28, 2026, the acting head of the U.S. Consumer Product Safety Commission told an international law enforcement conference in Bangkok that counterfeit safety marks and forged compliance documents now sit in the same enforcement lane as customs fraud. For leather jacket buyers, the shift lands at the document stage.

Why a Certificate Now Carries Criminal Weight

Peter A. Feldman, acting chairman of the CPSC, told the 19th International Law Enforcement Intellectual Property Crime Conference that counterfeiting is "not simply a matter of intellectual property theft" but "also a matter of public safety." The prepared keynote text describes a wider pattern of trade fraud, falsified compliance documents and deliberate evasion of consumer protection law.

The institutional backdrop is a joint Trade Fraud Task Force set up by the Department of Justice and the Department of Homeland Security in August 2025. By July 2026, the Department of Justice said it had passed $1 billion in combined recoveries, penalties, forfeitures and charged losses in under a year.

In a resource guide published in summer 2026, the United States identified product safety certificate forgery as a form of trade fraud. Feldman drew the consequence: a falsified certificate may be evidence of a regulatory violation, and depending on the facts it may also be evidence of customs fraud, smuggling or false statements, as the agency release sets out.

What the Agency Has Already Prosecuted

The enforcement record gives context. In 2025 the agency issued 542 recalls and safety warnings covering about 26 million products, and sent nearly 90,000 takedown notices to third-party sellers.

In June 2025, two Gree USA executives received federal prison sentences of 38 and 40 months for concealing fire hazards in defective dehumidifiers linked to more than 450 residential fires and over $19 million in damage. Feldman called it the first criminal prosecution of executives for failing to report under the Consumer Product Safety Act.

In April 2026, a federal court fined Royal Sovereign International $8 million after the company imported and sold more than 33,000 defective portable air conditioners made in China, allegedly linked to more than 40 fires and one death. It pleaded guilty to knowingly and willfully failing to report the hazard.

Those cases involve appliances, but the duty is general: reporting and documentation obligations attach to the importer, and they reach the company as well as the people who sign the file.

Counterfeit Marks and Data at the Border

In May 2026, the CPSC opened a national crackdown on counterfeit safety labels and marks, with a formal request for information to manufacturers, laboratories and consumer groups about how common such marks are and how they can be detected.

Feldman restated the legal position: it is unlawful to sell, distribute or import consumer products bearing registered safety certification marks that the seller knows, or should know, are being used without authorization from the mark owner.

The border side is electronic filing, which the CPSC implemented in July 2026 and which we covered in an earlier brief on certificate filing at entry. Importers of covered products must submit compliance certificate data before goods enter U.S. commerce.

Feldman said importers that provide inconsistent, incomplete or potentially fraudulent information should expect closer scrutiny, delays, denied entry or seizure, while accurate records should not cause unnecessary delay. He added one limit: "A certificate is not, by itself, proof that a product is safe."

What Leather Jacket Buyers Should Verify

For a buyer placing a leather jacket program, the practical reading is that documents are now compared against each other. Four checks cover most of it.

First, the compliance document should match the exact style, construction and material of the shipment, not a similar style from the same factory. Second, the test report should name the materials actually used, including shell, lining, interlining and trims, and be current for the batch.

Third, every safety or quality mark on a label, hangtag or packaging should be traceable to the organization that owns it, supported by written authorization. Fourth, the data filed at entry should reconcile with the commercial invoice, packing list and certificate.

Mismatches among those four documents are the pattern the task force treats as an indicator, not a clerical nuisance. None of this needs new systems: it needs a style-level file that travels with the order, and a buyer who asks for a report number and revision date rather than a scanned logo.

Danke, the brand of Dalian Danke Fashion Co., Ltd, assembles that file during sampling, alongside the leather jacket manufacturing process records behind each order. It supplies men's and women's leather jackets to importers, distributors and private label leather jacket programs from Dalian, China.

Buyers who want to review documentation before committing to a season can start with the men's leather jacket range at www.dankeleatherjacket.com, or send a specification to WhatsApp +86 13234076432.

Does electronic filing apply to every leather jacket shipment?

Not automatically. The requirement covers consumer products subject to a CPSC rule that requires a certificate, and coverage depends on the product and its components. Importers should confirm applicability with their customs broker before booking.

How can a buyer check that a safety mark is genuine?

Ask the supplier for the authorization issued by the organization that owns the mark, and for the test report the mark refers to. A mark alone is not evidence; the May 2026 request for information started from the premise that marks can be copied onto untested goods.

What happens when filed data does not match the shipment?

The agency's stated expectation is closer scrutiny, which can mean delays, denied entry or seizure, and a referral where the facts suggest fraud. Correcting a mismatch before the container arrives costs less than explaining it at the port.
