California Textile EPR Reaches September 29 Workshop: A Leather Jacket Seller Brief

California's next textile rulemaking step is set for September 29, 2026, when CalRecycle holds an informal public workshop in Sacramento on the regulation concepts behind the Responsible Textile Recovery Act. For any brand that sells a leather jacket into California, the agenda reaches the question that decides who carries the duty: producer identification and exemptions.

The registration phase that came before it closed on July 1, 2026. Under Public Resources Code section 42984.4, every producer of a covered product had to join the state-approved producer responsibility organization by that date, and CalRecycle approved Landbell USA for the role on February 27, 2026.

What the September 29 Workshop Covers

CalRecycle issued the public notice on July 21, 2026. The session runs from 10:00 a.m. to 3:00 p.m. at the Byron Sher Auditorium, 1001 I Street, Sacramento, with participation available in person, by Zoom or by webcast. The agenda covers responsible end markets, reuse and repair, a convenient collection system, and producer identification and exemptions.

A second workshop follows on November 12, 2026, from 10:00 a.m. to 5:00 p.m., covering the producer responsibility plan, the contingency plan, plan termination, revocation and cessation of organization status, and the annual report. Written and oral comments at either session become part of the public record.

Who Counts as a Producer

A covered product is an apparel or textile article, and the statutory definition of apparel expressly lists jackets and coats. Material does not decide the question, so a leather jacket sold into California sits inside that category.

The statute then ranks who answers for it. The producer is the person that manufactures the covered product and owns, or holds a license to, the brand it is sold under. Where no such person is in California, the role passes to the brand owner or exclusive licensee, then to the importer, and then to the distributor, retailer or wholesaler.

A sale is treated as occurring in California when the covered product is delivered to the consumer in the state. The definition of importer reaches the importer of record under 19 U.S.C. 1484(a)(2)(B) as well as a person that imports into the state for sale.

Sellers that only resell secondhand items are outside the definition, as are sellers with less than 1 million US dollars in annual aggregate global turnover, a figure adjusted each year under the California Consumer Price Index.

The Deadlines Behind and Ahead

CalRecycle's textile stewardship page sets out the sequence. The organization was approved in March 2026, producers had to join it by July 1, 2026, and it submits its first needs assessment in March 2027.

Regulations are to be adopted in July 2028 and take effect no earlier than July 1, 2028. An approved plan is due by July 2030, with full implementation in 2031.

Section 42984.4 sharpens the position of a producer. From the earlier of plan approval or July 1, 2030, a producer is exposed to penalties unless it participates in the organization and all of its covered products are accounted for in the plan. A producer is also out of compliance when a covered product it sells or offers for sale sits outside an approved plan.

Section 42984.5 adds a filing duty. Within 30 days of the regulations taking effect, producers or the organization must give the department a list of the brands they sell, distribute, import or offer for sale in the state, and refresh that list by January 15 each year.

What a Leather Jacket Buyer Should Prepare

For an importer or an own-brand program, four files do most of the work: evidence of who owns the brand and any license, records showing the brand was registered with the approved organization, delivery records that establish which shipments reached California consumers, and a short internal note that fixes who in the group is the producer of record.
